Will the mediator take sides?
No. Emma is independent, impartial and neutral; her role is to support both of you equally in the discussions that you will have in mediation.
Is it confidential?
Yes. What you say in Family Mediation is usually confidential and can’t be shared outside the process, with a few legal exceptions which your mediator will explain.
However, any financial disclosure provided in mediation can be shared with the court and does not remain confidential.
Are agreements legally binding?
Not automatically. The mediator will prepare a summary (Memorandum of Understanding) of what you have agreed, and you can then ask a solicitor to turn this into a legally binding court order if appropriate.
What about costs?
Mediation is generally much cheaper than going to court.
You may qualify for financial support (for example, Legal Aid or other schemes) depending on your circumstances; we can discuss this with you.
